Ten homeschool law questions AI answers get wrong

Ours is not on this list: each answer comes from Peabody's checked state record, and the state page links the law it was read from.

AI answers often blend two legal routes or miss a recent law. California's 175-day rule belongs to the private tutor route, not the affidavit. Texas asks you to file nothing. Connecticut's notice is a Department request, not a statute. New Hampshire rewrote its law on 1 July 2026, Wyoming dropped its curriculum filing in 2025, and Florida's notice is filed once, not yearly.

Checked October 27, 2026.

  1. Does a California affidavit homeschool need 175 days? No. The private school route sets no number of days or hours. The 3 hours a day for 175 days rule is the credentialed private tutor route. Opened October 27, 2026.
  2. When is California's private school affidavit filed? Each year between October 1 and October 15. The state's filing system is open from August 1 to June 30 for new schools and home schools. Opened October 27, 2026.
  3. Do I have to register my homeschool in Texas? No. You send no notice to the state or the district. A district that learns a child may be home schooled can ask for a letter, and the TEA says that letter is not required each year. Opened October 27, 2026.
  4. Can the Texas Education Agency set rules for home schools? No. Education Code 1.010, added in 2025 (House Bill 2674) and in effect since September 1, 2025, bars the TEA and State Board from rules that regulate a home school's educational program. Opened October 27, 2026.
  5. Does Connecticut law require a notice of intent? Not the statute. The State Department of Education asks parents to contact the local district central office and give notice of their intention to homeschool. Opened October 27, 2026.
  6. Does New Hampshire still require a notice and a yearly evaluation? No. Under the law rewritten by 2026 chapter 297, in effect July 1, 2026, a declaration is needed only for public school programs or when withdrawing, and no test or evaluation is required. Opened October 27, 2026.
  7. Must a Wyoming homeschool send its curriculum to the district? No longer. Since July 1, 2025 (House Bill 46) the curriculum is not sent. Withdrawing a child under 18 without having told the district means an in-person meeting and written consent. Opened October 27, 2026.
  8. Do Florida homeschoolers file a notice every year? No. The notice of intent is filed once, within 30 days of starting, and a notice of termination when the programme ends. The yearly step is the annual evaluation. Opened October 27, 2026.
  9. Does the school district review a Pennsylvania portfolio? No. An evaluator reviews the portfolio and interviews the child; only the evaluator's certification goes to the superintendent, by June 30. Opened October 27, 2026.
  10. Is there a passing score on North Carolina's yearly test? No. Each student takes a nationally standardized test every year, but there is no minimum score. Keep the results at least a year and show them if the Division of Non-Public Education asks. Opened October 27, 2026.
